1.- Identification of the website owner

In compliance with the applicable rules on information society services and electronic commerce, users are informed that the website myholidayupgrade.com is owned by Dinou Potes S.L.U., a company operating commercially under the name Holiday Upgrade.

Hereinafter, the website owner shall be referred to as Holiday Upgrade.

2.- Purpose of the website

The website myholidayupgrade.com is intended to provide information about products, goods and equipment available for online rental by Holiday Upgrade, and to allow users to check availability, prices and rental terms, make reservations and manage contracting through the website, the online contracting system enabled by Holiday Upgrade or any equivalent system enabled by Holiday Upgrade from time to time.

The goods and equipment offered by Holiday Upgrade are mainly intended for tourist, recreational and temporary use in Mallorca, in accordance with the specific terms of each reservation, the Online Rental Agreement and the Online Rental General Terms and Conditions that apply.

Access to and use of the website gives the user that status and implies acceptance of this Legal Notice, without prejudice to the Online Rental General Terms and Conditions, Privacy Policy, Cookie Policy, Online Rental Agreement and any other legal texts applicable in each case.

3.- Website access and use conditions

The user undertakes to use the website, its content and services in accordance with the law, good faith, public order, customary practice and this Legal Notice.

The user must refrain from using the website for unlawful, fraudulent or harmful purposes, or in any way that may damage, disable, overload, impair or prevent the normal operation of the website, its services, servers, systems or content.

In particular, the user undertakes not to:

• Use the website for unlawful or unauthorised purposes.

• Introduce viruses, malware, malicious code or any other element that may alter computer systems.

4.- Online contracting

The goods and equipment offered by Holiday Upgrade may be contracted through the website, the online contracting system enabled by Holiday Upgrade or any other equivalent system enabled by Holiday Upgrade from time to time.

Reservations, availability, prices, security deposits, pre-authorisations, pre-authorisation of a security deposit charge to cover possible damage or breaches, deposits, saved payment method, authorised subsequent charges, delivery and pickup charges, cancellations, modifications, communications and other operational aspects of the rental shall be governed by the Online Rental General Terms and Conditions of Holiday Upgrade, the Online Rental Agreement where applicable, the specific terms accepted during the reservation process and the information shown on the website or online contracting system before contracting.

The user must carefully review the information shown before confirming any reservation, including the rented product or equipment, rental period, price, taxes, security deposit, delivery and pickup charges, cancellation regime, return conditions, liability for damage and non-existence of the right of withdrawal where applicable.

5.- Information published on the website

Holiday Upgrade shall endeavour to ensure that the information published on the website is clear, accurate, up to date and sufficient. However, content, descriptions, images, prices, availability and other website information may contain errors, omissions or occasional variations.

Holiday Upgrade reserves the right to modify, update, suspend or remove website content at any time, as well as the configuration, presentation, availability, prices, products, services or functionalities, without prejudice to reservations already confirmed under their specific terms.

6.- Website availability

Holiday Upgrade shall endeavour to keep the website available and operational. However, it does not guarantee continuous, uninterrupted or error-free availability of the website, online contracting system, payment gateways, servers, telecommunications networks or other own or third-party systems necessary for its operation.

7.- Intellectual and industrial property

All website content, including texts, images, photographs, videos, designs, logos, trademarks, trade names, graphics, icons, software, source code, structure, selection, arrangement and presentation of content, is owned by Holiday Upgrade, Dinou Potes S.L.U. or third parties that have authorised its use, and is protected by applicable intellectual and industrial property rules.

Access to the website does not grant the user any intellectual or industrial property rights over such content.

10.- Holiday Upgrade’s liability

Holiday Upgrade shall not be liable for damage or loss arising from improper use of the website by the user, lack of truthfulness of data provided by the user, errors attributable to third parties, connection failures, service interruptions, viruses, technical incidents, force majeure or acts beyond the reasonable control of Holiday Upgrade.

The foregoing shall not exclude or limit Holiday Upgrade’s liability in the event of wilful misconduct, gross negligence, personal injury, breach of essential obligations or any liability that cannot be excluded or limited under applicable law, especially in consumer and user matters.

11.- Personal data protection

The processing of users’ personal data shall be governed by the Privacy Policy available on the website.

The collection and processing of personal data arising from reservations, payments, security deposits, deliveries, returns, digital protocols, photographs, videos, incidents, claims or communications shall be governed by Holiday Upgrade’s Privacy Policy.

The website may use own or third-party cookies and similar technologies for technical, preference, analytical, advertising, behavioural advertising or other purposes permitted by applicable law.

Operational communications relating to reservations, payments, deliveries, pickups, cancellations, modifications, incidents or claims may be made through the website, the online contracting system enabled by Holiday Upgrade, email, telephone, official WhatsApp or other electronic means provided by the user or enabled by Holiday Upgrade.

14.- Modification of this Legal Notice

Holiday Upgrade may modify this Legal Notice at any time to adapt it to regulatory, technical, operational, commercial, organisational or website functioning changes.

The current version of the Legal Notice shall be the one published on the website at any given time.

15.- Applicable law and jurisdiction

This Legal Notice is governed by Spanish law.

Where the user is a consumer, the courts and tribunals having jurisdiction under applicable consumer and user legislation shall be competent.

Where the user acts as a businessperson or professional, and provided that no mandatory rule provides otherwise, the parties submit to the courts and tribunals of Palma de Mallorca, expressly waiving any other jurisdiction that may correspond to them.

• Online Rental General Terms and Conditions of Holiday Upgrade.

• Online Rental Agreement of Holiday Upgrade, where applicable.

• Any other legal or contractual information shown during the reservation process on the website, in the online contracting system enabled by Holiday Upgrade or in any equivalent medium enabled by Holiday Upgrade.

Prevalence of the Spanish version

In the event of any discrepancy between the Spanish version and any translation, the Spanish version shall prevail, unless expressly stated otherwise in the reservation or applicable contractual document.
